Introduction

The services provided by ITITAN Hosting Solutions S.R.L. are intended for individuals, legal entities, legal institutions, and others who have the legal capacity to enter into a contractual collaboration and continue to hold the status of a Client. ITITAN Hosting Solutions S.R.L. reserves the right to modify these provisions without prior notice. By using the services, you agree to these modifications regardless of prior notifications. All ITITAN Hosting Solutions S.R.L. clients are required to familiarize themselves with and adhere to these terms. Any violation may result in the suspension of services and the client's account, with or without notification, and without refunds. Acceptance of these Terms and Conditions is confirmed through an explicit act of consent, such as clicking any button containing the text "I agree" or similar wording.

General Terms

By choosing to register, you are obligated to provide us with accurate information, including your name, address, and other relevant details. Using false information or failing to update it may result in the invalidation of your account or the inability to contact you. The information you provide must be accurate, current, and genuine. By accessing your account and using your personal password, you are responsible for all actions resulting from their use. ITITAN Hosting Solutions S.R.L. cannot be held responsible for errors caused by customer negligence in terms of account security and confidentiality. You are responsible for the confidentiality of your account and must not disclose your data (especially authentication information) to an unauthorized person using the account. The minimum age is 14 years or older. If you are under 14 years old, you are not eligible to use our services. If you are between 14 and 18 years old, you must have the permission of your parents/legal guardian to use our website and services. We do not assume responsibility or liability for the age of customers. You are obligated not to disclose or copy various software applications that we have implemented in our services. Additionally, the purchased services cannot be transferred between customers.

Service Usage

The services offered by ITITAN Hosting Solutions S.R.L. should be used for lawful purposes only. Any activities that may be considered illegal are strictly prohibited. The manner in which the client uses the services provided by ITITAN Hosting Solutions S.R.L. can affect the proper functioning of the equipment and the network, which impacts our ability to provide quality services to all customers. Therefore, the following activities are prohibited: 1. Storing files for file sharing, torrents, mass downloads, etc. 2. Installing modules/extensions that negatively affect service performance, modules with security issues, modules intended to add virtual players (bots). 3. Falsifying TCP-IP packets. 4. Restricting or preventing another client from using services offered by ITITAN Hosting Solutions S.R.L. 5. Using scripts for proxy or IRC, or similar FormMAIL, PhpSHELL, or others, including commercial scripts with known security vulnerabilities, Chat ROOM, Chat WAP, IRC EGG Drops, TORRENT Trackers, Top SITES, ONLINE Games. 6. Running scripts at intervals of less than 5 minutes. 7. Using services to create or transmit computer viruses, FLOOD, WORMS, Mail BOMB, Port SCAN, or engaging in DoS attacks. 8. Using services in an abusive manner resulting in network difficulties. 9. Collecting or harvesting information on email addresses of third parties without their consent. 10. Collecting personal information for unlawful use. 11. Unauthorized access to data, systems, or networks (SPOOFING, PROXY, HACKING, SNIFFING, etc.), including any attempt to test, probe, or scan system or network vulnerabilities or create security breaches without the owner's authorization. Uploading corrupted files, viruses, or any other similar software or applications is prohibited. Any interference with the service provided to a user, a server, or a network, including actions such as FLOOD, Mail BOMB, deliberate system overloading, is prohibited. Using the services for activities prohibited by current Romanian legislation is also not allowed.

Refunds & Service Cancellation Requests

We offer a full refund only in the following situations: 1. The contact details provided by the client must be entirely accurate. 2. The issue is caused by our services and cannot be resolved (this will be determined by our team). Recurring payments are non-refundable and must be canceled by the client through the payment provider they used, such as Stripe/PayPal. Payments made through PaySafeCard are non-refundable. Service renewals are automatic and are done from the existing credit in your account or through the payment method used at the end of the order. The cancellation period for a service is 29 days from the initial payment, with the cancellation deadline being one day before the due date. Credit is non-refundable. If a client no longer wishes to use a service provided by ITITAN Hosting Solutions S.R.L., they have the option to submit a cancellation request directly from their account. In this case, the client can choose to cancel the service immediately or at the end of the billing period, but refunds are not possible. After processing the request, all data uploaded to that service will be permanently deleted. Additionally, a canceled service cannot be reactivated after the cancellation request has been processed.

Technical Support Provided

Clients receive technical support from ITITAN Hosting Solutions S.R.L. only if the service for which support is requested is active and has no outstanding invoices. Technical assistance is provided exclusively through support tickets opened on the website and through the Discord social network. We reserve the right to permanently terminate support in the following cases: indecent language and any form of misconduct towards our support team, abuse of support requests. In such cases, ITITAN Hosting Solutions S.R.L. may close the client's account with or without notification. We are not obligated to provide support for various software/platforms installed by the client on our services, as they are not part of the service provided by ITITAN Hosting Solutions S.R.L.

Damages

The client acknowledges and accepts that in any situation where they may claim damages from the provider, the total amount of damages requested for any reason, which may be paid by the provider, cannot in any way and under any circumstances exceed the total amount of fees/taxes paid by the client to the provider.

Content Policy

The services provided by ITITAN Hosting Solutions S.R.L. allow you to upload, implement, and operate applications for both private and commercial use. It is the user's responsibility to verify their own information to respect copyright and trademark rights. The client is obligated not to publish content that violates the rights of third parties or applicable laws. The services provided by ITITAN Hosting Solutions S.R.L. may only be used for lawful purposes. Transmitting, distributing, or storing any information, materials, or data that incorporate current legal provisions or that can directly or indirectly facilitate the violation of any legal provision is prohibited. Under no circumstances will the services provided by ITITAN Hosting Solutions S.R.L. be used for: 1. materials or informational content that violate copyright, trademark rights, or any other intellectual property rights belonging to a third party; 2. nudity, child pornography, any images or text with sexual or obscene content without complying with current legal conditions; 3. viruses, trojans, or similar. Pirated software or software targeting software piracy or similar activities; 4. threats, harassment, abuse, or slanderous statements; 5. any images or text intended to promote xenophobia; 6. text or materials of a violent nature; 7. defamatory, offensive, denigrating, or slanderous content; 8. discriminatory or racial content; 9. fraudulent, false, deceptive, or confusing content; 10. content that invades a third party's privacy or violates their legal rights; 11. obscene, vulgar, indecent, or illegal content. The client commits to responding to complaints regarding content within 24 hours of receiving notifications. ITITAN Hosting Solutions S.R.L. is not obligated to verify or review the content published by clients. ITITAN Hosting Solutions S.R.L. reserves the right to remove or modify at its discretion any client content that is found to violate these terms and conditions, with or without prior notice. If the client collects/processes personal data, it is their responsibility to ensure that this collection/processing complies with current legislation.

Data Integrity

The client will have access to accounts through a combination of email and password. It is the client's responsibility to keep this information and other sensitive information secure. The client will be responsible for any abuse through authorized or unauthorized use of this information. ITITAN Hosting Solutions S.R.L. does not assume responsibility for the protection of the client's personal electronic device used to access the contracted accounts/services. It is the client's responsibility to ensure that both the applications installed/used on the hosting accounts and their personal devices are up to date and secure. ITITAN Hosting Solutions S.R.L. does not assume responsibility for security breaches of client-installed applications or any damage caused by their operation. The responsibility for this rests with the application administrator and developer. It should be noted that we do not offer any guarantees for the integrity of backup copies, and the client is solely responsible for the existence of backup copies of data. The client is responsible for maintaining the security of their client account and authentication data. The client is fully responsible for the activities carried out in their account and any actions related to the rented service. You agree to notify ITITAN Hosting Solutions S.R.L. about any unauthorized access or other security breaches. ITITAN Hosting Solutions S.R.L. does not assume responsibility for any loss or damage related to the client's ability to remedy it. ITITAN Hosting Solutions S.R.L. is not responsible in any way for the actions or omissions of the client or the users of the service's resources, even in the case of damage caused by them due to their actions or omissions. If any compensation or fines need to be paid, the client will be required to pay these amounts, and not ITITAN Hosting Solutions S.R.L. ITITAN Hosting Solutions S.R.L. does not check the content uploaded, stored, or transferred by the client or any third party, and therefore cannot be held responsible in any way for this. However, if ITITAN Hosting Solutions S.R.L. is notified by a competent authority in accordance with relevant civil/criminal procedural provisions, immediate measures can be taken to remove or block access to the same content subject to the notification.

Payments & Billing

Depending on the chosen service, the billing period may vary. All payments will be made based on pro forma invoices issued by ITITAN Hosting Solutions S.R.L. The invoice's amount is due at the beginning of each payment period, within 7 calendar days from the pro forma invoice's issuance date. The client agrees to pay for the services in advance for the period during which they are provided. A partially paid invoice will not be considered a CONFIRMED invoice. In fact, the services will not be extended. Requests for recalculating the due date based on partial payments will not be considered, in other words, the services will not be extended according to the number of days used. Only after the invoice is paid can we provide the service. Payment is made in advance for all the services we offer. If the invoice is not paid within the specified time frames, we have the right to suspend the client's status on our website and terminate the service. To obtain the services, access data for the paid service will be provided in the email associated with your account. Depending on the purchased service, the email with access data may be received immediately after payment for products with automatic activation or within a maximum of 3 working days for products without automatic activation. Payments by bank transfer are made at the exchange rate of the National Bank of Romania on the day the invoice is generated. For confirmation, please contact us through a support ticket using the reference code.

Limitation of Liability

ITITAN Hosting Solutions S.R.L. cannot be held responsible for damages caused by the temporary unavailability of equipment or the network, regardless of the reason for the interruption. This provision includes damages resulting from data damage or loss. The client agrees to indemnify and hold us harmless in connection with any claims, damages, including, but not limited to, those resulting from third parties, as a result of the client's use of our services causing damages to our client. We do not guarantee that our services will not be interrupted or error-free. Our services are provided without any warranties of any kind. You are solely responsible for the files you upload to our services.
